No Contingencies
All auction properties are sold in "as is, where is" condition. No purchase shall be contingent on financing or any other contingencies except seller's warranty of good title. Buyers are encouraged to inspect properties prior to auction. Terms and conditions are non-negotiable.
Registering to Bid
In order to bid, potential buyers must register and agree to the terms and conditions. Bidders need to be aware by bidding online they are entering into a binding contract before bidding. Bidders are acknowledging this by agreeing to the terms and conditions. By registering to bid you agree to all terms and conditions as outlined and agree to all terms and conditions as outlined and agree to execute the sales agreement and to complete transaction.
Bid Deposits
Bid Deposits must be received within 48 hours .If deposit is not received within the 48 hour time period, the property will be awarded to the back up bidder. Bid Deposits will only be accepted in the form of cashier check, or certified funds, or wired funds. The amount of the Bid Deposit is ten percent of the high bid amount. The high bidder will submit the Bid Deposit along with Purchase and Sales agreement.
Buyer's Premium
A buyer's premium of ten percent (10%) or $1,000 whichever is greater will be added to the high bid to determine the total purchase price.
Closing
The entire purchase price less bid deposit must be paid by cashier's or certified check, or wired funds at closing. The closing shall take place not later than twenty one (21) days after the auction.
Broker Participation
If a buyers chooses to obtain the services of a real estate agent the buyers agent must complete and fill out the Broker Participation Agreement Form below. Morris Auction Express will not be liable for any Buyer Broker Agent Fees without a completed Broker Participation Agreement. .
Disclaimer
Buyer accepts the property in as-is, condition. Buyer accepts all faults known or unknown, existing or that may arise later. Buyer further agrees that the Seller, Morris Auction Group or MorrisAuctionExpress.com have not made and do not make any representations, warranties, promises, covenants, agreements, or guarantees other than those in written form. All information provided on web site or delivered was derived from sources believed to be correct, but is not guaranteed.
By placing this bid I agree that on any real estate that I bid on and I am the high bidder, I will pay the amount of the deposit as advertised, sign the Real Estate Sales Contract and close the sale as specified in said contract. If I default on this agreement, all legal fees incurred by Auctioneer will be responsibility of the undersigned.
Potential buyers must perform such independent inspections of the property as they deem necessary to verify information received from Morris Auction Group or any other source that he/she intends to rely upon in making their determination of the value of the property or the amount of their bid. All due diligence should be completed prior to the auction. No bid should be made by any bidder if there is to be a contingency in the sales contract.
Morris Auction Group, LLC and it's representatives represent the Seller.
Bidder/Buyer agrees to indemnify and hold harmless Morris Auction Group, LLC its representatives, agents, and employees for any claims, actions, causes of actions, demands, rights, damage losses or costs that may result or occur because of any lien or encumbrances or injury on such property at the time of auction or otherwise.
